TERMS AND CONDITIONS OF SALE
Product Warranty
Merchandise purchased is sold without warranties of any kind express or implied including but not limited to warranties of performance, merchantability, or fitness for a particular purpose by DRC.
Manufacturers’ warranties vary, for warranty information check with each manufacturer. Any alteration by the purchaser of goods sold including treatment by fabric protectant shall render this warranty void. Purchaser holds DRC harmless from all damages resulting from wear or fading of any coverings, material, upholstery, and/or leather that is not guaranteed by mills or tanneries.
Cancelation and Returns
All orders are custom orders and therefore are not eligible for cancelation. If an order were to be canceled, a minimum 35% restocking fee is due. The restocking fee can increase based on the stage of production of the product.
Floor Samples
Products purchased from the DRC’s showroom or warehouse (floor samples) are final sale and sold as is. Purchaser understands that floor samples must be inspected by the purchaser or purchaser’s agents at the time of pick up. Purchaser agrees to hold DRC harmless for any damages after merchandise leaves DRC’s showroom or warehouse facility. Floor samples have no warranties. Purchaser further agrees to deal with their own agents if there are any damages.
Delivery
DRC is not responsible for receiving or delivering goods. The purchaser is responsible for providing a receiving warehouse, scheduling delivery, and planning for any limitations that the product destination might have (elevator, hallway, and doorway size and availability). DRC is not responsible for clients' local receiving warehousing or delivery costs. Receiving warehouses are selected by the purchaser. DRC does not recommend freight carriers, forwarders, or warehouses. However, DRC can provide a list of local freight carriers, forwarders, or warehouses, DRC makes no representation as to their competency or honesty and the purchaser holds DRC harmless from any and all damages resulting from the use by the purchaser of such freight carriers, forwarder or warehouse.
Claims
In the event of damaged or faulty merchandise, the purchaser is responsible for contacting DRC at the time of delivery and completing an online Claims Form (https://designer-resource-center.odoo.com/helpdesk/review-team-4). Claims will not be submitted until the form is properly completed and submitted to DRC. DRC will not be responsible for a missed manufacturer claim submission deadline if the purchaser does not provide all the information on time. The purchaser is responsible for delivering all necessary information and images.
Payment Terms
Payments made with cards will require a 2% processing fee. Credit cards will not be accepted to pay for final balances at any time. Purchaser agrees not to stop payment on checks payable to Designer Resource Center or advise their credit card issuer to stop payment. Purchaser acknowledges that purchaser's only recourse is to obtain a store credit and only upon the terms set forth.
Payments for in-stock and Dropship items are due upfront. Payments for custom goods that are shipping to a receiving warehouse with a lead time of over two weeks are available for a payment plan requiring a 50% deposit to place the order and the remaining 50% upon product shipment from the manufacturing facility. Orders will not be placed until the required payment is received. Delivery will not be scheduled until full payment is received. DRC is not responsible for any receiving warehouse storage fees or delays caused by the purchaser’s missing payments.
Disputes
All disputes are to be submitted for resolution to the American Arbitration Association in Palm Beach County Florida and a judgment upon the award to be rendered by a single arbitrator may be entered in circuit or County court in Palm Beach County. The prevailing party shall be entitled to all attorney’s fees and costs.
